In general, the development of the theory of the legal system has focused on the contributions of legal positivism authors, leaving to one side the contributions of natural law theory. This study seeks to rebuild the theory of the legal system developed by the School of Salamanca’s founder, Francisco de Vitoria, showing its explanatory advantages in comparison with the first analytical legal theory of legal system formulated by John Austin. This study shows that, just as in Austin, it is possible (...) in Francisco de Vitoria to reconstruct the existence and identity criteria of legal systems from the notions of command and sovereignty. These findings allow us to maintain that 300 years before Austin, and in a non-analytical environment, Francisco de Vitoria developed a theory of legal system. (shrink)

In 1817, in the preface to his Rein analytischer Beweis, Bernard Bolzano revealed that he had decided to postpone the publication of any subsequent instalment of his Beyträge zu einer begründeteren Darstellung der Mathematik because of the few and ‘superficial’ reviews of its first instalment, published in 1810. Bolzano’s transcriptions of the only two known reviews of this book are conserved at the Literární archiv Památníku národního písemnictví / Muzea literatury, in Prague, together with another manuscript on his Beyträge, the (...) provenance of which was unknown to Bolzano’s scholars until recently. In this paper it is shown that this latter manuscript is a draft of an announcement that was published at the time and that was indeed written at least to some extent by Bolzano himself. This hitherto unknown announcement of Bolzano’s Beyträge not only solves the mystery surrounding that manuscript, but also helps to date the publication of this book more precisely and provides an unusual insight into what we must take Bolzano himself to have considered most noteworthy about his work, namely his study on logic. El hecho de que el tema carcelario aparezca con frecuencia en sus relatos y novelas, en algunos de los cuales la cárcel deviene un personaje más, obedece precisamente a su interés en dicho problema. Como aquí se muestra, Revueltas no sólo buscaba exponer y analizar la enajenación humana, sino a la vez explorar posibles vías de liberación. De ahí que, mientras (...) que en sus primeros trabajos se centró en el sistema penitenciario, gradualmente pasó a abordar en ellos el encierro en el espacio público y en la propia conciencia. The dissemination and reception of Bernard Bolzano's ideas were not only mediated by his personal circumstances and context but also by the vicissitudes of his work. This paper traces the fate of his works from his death in 1848 to the publication of the first volume of his Gesamtausgabe in 1969, and it does so with the help of one of the last published volumes of this edition, namely the Bolzano‐Gesamtbibliographie 1804–1999. As the paper shows, this book is more than (...) a mere list of publications and constitutes a highly valuable resource for anyone interested in Bolzano studies, the use of which is explained in detail. The case of virtual reality indeed makes explicit the common assumption of technology as something alien to cultural, human production. However, technology shares our limits and it is subject to our plans, regardless of whether someone insists on assuming it independent of ourselves or insists on replacing our interaction with natural space by an interaction in an entirely controlled virtual environment. The observation that placebo administration induces the release of dopamine in the ventral (...) striatum of patients with Parkinson’s disease suggests a link between the placebo effect and reward mechanisms. In addition to Parkinson’s disease, the placebo-reward model may also apply to other disorders. However, the relative contribution of the different neurotransmitters and neuropeptides that are known to be involved in modulating the activity of the limbic system may be disease-specific. Thus, while the placebo-induced clinical benefit observed in Parkinson’s disease would mostly reflect the release of dopamine in the dorsal striatum, the activation of opioid and serotonin pathways could be particularly implicated in mediating placebo responses encountered in pain and depression, respectively. El objetivo central de este artículo consiste en argumentar a favor de la tesis de que es imposible o, al menos, excesivamente difícil evaluar creencias basadas en la memoria, especialmente cuando se justifican en los denominados recuerdos episódicos, lo que implica que las creencias basadas en la memoria episódica no pueden ser justificadas suficientemente para alcanzar el estatus de conocimiento. Para lograr este objetivo expondré brevemente las diferencias y las relaciones que hay entre memoria, recuerdo, creencia y conocimiento (o saber). (...) Posteriormente presentaré diversas formas en que ha sido entendida la memoria, así como algunas de las pruebas que han servido para medir la memoria ya que en función de estas se puede mantener que hay recuerdos falsos. Aunque estas pruebas son valiosas para los propósitos para las que fueron diseñadas, hay casos que se les escapan y estos tienen implicaciones epistemológicamente importantes, entre ellas que la memoria episódica no es una fuente confiable para justificar algunas de nuestras creencias y que estas cuenten como conocimiento. El esclarecimiento y la determinación exacta de cuáles pueden haber sido las fuentes, autores o ideas que influyeron decisivamente el pensamiento de Friedrich Nietzsche y el modo como tales referencias teórico-conceptuales pudieron haber quedado incorporadas y expresadas luego en toda la extensión de su obra, constituye uno de los asuntos más complejos y difíciles de abordar para la investigación académica especializada. A materializar dicha tarea indagatoria se dirige este artículo, buscando con ello proveer una estrategia de lectura que permita (...) visualizar focalizadamente ciertos elementos centrales de la reflexión nietzscheana que no siempre son bien reconocidos en la investigación respectiva, cuando no quedan desatendidos por completo en el corpus interpretativo que se ha venido consagrando en relación con su quehacer filosófico. Apoyándose en la investigación especializada, este artículo busca precisar el impacto que pudo haber tenido el pensamiento del filósofo F. A. Lange en Nietzsche; sobre todo reconociendo ciertos elementos de la filosofía crítica de Kant que habiendo sido inicialmente recogidos por Lange, fueron luego heredados como remanentes por Nietzsche, aunque también modificados en su obra, fenómeno que hemos denominado “criticismo radical”. Este artículo constituye un avance de la biografía completa de Francisco de Paula de Arrangoinz y Berzábal (1811-1892). Se trata de un personaje enigmático y que hasta la fecha quienes lo han tratado no señalan correctamente los datos biográficos duros, como su nacimiento y muerte. Con el fin de situarlo y comprender su origen social y su trayectoria, se abarcan los años 1799 a 1846. Se estudian sus antecedentes familiares, su formación académica y sus dos primeras misiones consulares en (...) class='Hi'>fuentes primarias inexploradas, profundizando en los periodos menos conocidos. Se incluye un corolario en el que se revisa someramente el periodo de 1847 hasta su fallecimiento en 1892. La información referente a sus últimos días también constituye una novedosa aportación. El presente artículo indaga si ¿es el sujeto un ser autónomo en la deliberación política o sonlos pensamientos, las posturas y las formas de la organización política mediadas por las distintas herramientas comunicacionales a las que se ve expuesto quienes lo determinan? Así, analiza larelación que existe entre mass media y política, con la capacidad deliberativa del individuo altomar decisiones en el contexto político, a partir de Chomsky y Han. La metodología es cualitativa con diseño documental, el instrumento son fichas (...) bibliográficas aplicadas a fuentes primarias y secundarias. Se usan bases de datos con el algoritmo: “Neoliberalismo, psicopolítica, big data, medios de comunicación de masas y democracia”. Se analizan 13 libros y 20 artículos. Se identifican las nuevas formas y herramientas de organización política y la relación entre política y medios de comunicación. Se concluye que: 1) el neoliberalismo direcciona la idea de libre mercado hacia el individuo mismo, 2) es necesaria una ciudadanía crítica que tenga un rol más activo en lademocracia, 3) se identifica a la psicopolítica como una nueva forma de organización política, 4) lanueva herramienta de la política es el big data, 5) se evidencia que la relación entre política y massmedia está vinculada con los grupos de poder y 6) la emocionalización de la comunicación políticadisminuye la autonomía individual. This article examines corporate social responsibility (CSR) through the lens of political ontology. We contend that CSR is not only a discursive mean of legitimization but an inherently ontological practice through which particular worlds become real. CSR enables the politics of place-making, connecting humans and nonhumans in specific territorial configurations in accordance with corporate needs and interests. We discuss three CSR mechanisms of singularization that create a particular corporate ontology in place: (1) community engagements that form ‘stakeholders’; (2) CSR standards (...) and certifications that produce singular sustainable environments; and (3) CSR reporting that erases ontological conflicts and enables the singularized representation (of the environment and the community) to travel to other locations of the corporate world. We argue that these ontological CSR practices obscure the pluriverse of other world and place-making practices that would create different kinds of sustainabilities based on less extractive and non-corporate ways of being in place. Earnings management behavior is a concern of standard-setters, regulators and the accounting profession. This study examines the ethics of this practice using a national sample of 763 accounting practitioners, faculty and students. Possible determinants of the ethics of this practice such as perceived role of ethics and social responsibility, and personal moral philosophies (i.e. idealism and relativism) are explored. Results indicate a positive relationship between social responsibility, focus on long-term gains, idealism, and the ethical perception of earnings management and negative (...) relationship between focus on short-term gains, relativism and the ethical perception of this practice. Implications for the accounting profession as it deals with the issue of earnings management are discussed. (shrink)

Part of the task in studying human evolution is developing a deep understanding of what we share, and do not share, with other life, as a mammal, a primate, a hominin, and as members of the genus Homo. A key aspect of this last facet is gained via the examination of the genus Homo across the Pleistocene. By at least the later Pleistocene members of the genus Homo began to habitually insert shared meaning into and onto their world forming one (...) of the bases of contemporary human abilities to develop a distinctive human niche and human culture. Meaning-laden cultural dynamics constitute the core of a ubiquitous semiotic ecosystem, which in turn structures the architecture of the complex niches and niche construction processes that characterize humanity today. Here, I offer a summary of Pleistocene evolution of the genus Homo and an argument for when and how that extensive and distinctive capacities for shared meaning-making and a particularly dynamic niche construction emerged. AI systems are bringing an augmentation of human capabilities to shape the world. They may also drag a replacement of human conscience in large chunks of life. AI systems can be designed to leave moral control in human hands, to obstruct or diminish that moral control, or even to prevent it, replacing human morality with pre-packaged or developed ‘solutions’ by the ‘intelligent’ machine itself. Artificial Intelligent systems (AIS) are increasingly being used in multiple applications and receiving more attention from the (...) public and private organisations. The purpose of this article is to offer a mapping of the technological architectures that support AIS, under the specific focus of the moral agency. Through a literature research and reflection process, the following areas are covered: a brief introduction and review of the literature on the topic of moral agency; an analysis using the BDI logic model (Bratman 1987); an elemental review of artificial ‘reasoning’ architectures in AIS; the influence of the data input and the data quality; AI systems’ positioning in decision support and decision making scenarios; and finally, some conclusions are offered about regarding the potential loss of moral control by humans due to AIS. This article contributes to the field of Ethics and Artificial Intelligence by providing a discussion for developers and researchers to understand how and under what circumstances the ‘human subject’ may, totally or partially, lose moral control and ownership over AI technologies. The topic is relevant because AIS often are not single machines but complex networks of machines that feed information and decisions into each other and to human operators. The detailed traceability of input-process-output at each node of the network is essential for it to remain within the field of moral agency. Moral agency is then at the basis of our system of legal responsibility, and social approval is unlikely to be obtained for entrusting important functions to complex systems under which no moral agency can be identified. Retomando el tan explorado debate entre elitismo y populismo penal, este libro adopta una perspectiva republicana para argumentar a favor de un mayor grado de participación popular en la determinación de las penas. En el plano de la teoría no-ideal, se argumenta que fenómenos como las dinámicas de indignación y los linchamientos, contrariamente a lo que se sugiere, cuentan a favor de la democratización de los sistemas penales. En este sentido, el libro disputa el enfoque de quienes sostienen que las (...) preferencias punitivas arbitrarias de los ciudadanos deberían favorecer mecanismos que aíslen la política criminal de la influencia popular. Por el contrario, se argumenta que tanto el elitismo como el populismo penal operan como fuentes de diferentes tipos de dominación y, por lo tanto, deben evitarse en un estado republicano. Adicionalmente, el libro se propone responder a la necesidad de revisar los presupuestos teóricos del pensamiento crítico sobre los sistemas penales señalada por Carlos Santiago en su debate con Eugenio Raúl Zaffaroni. En consecuencia, la pregunta sobre cuál debe ser el grado de participación popular en los sistemas penales es abordada en el marco de la teoría política republicana. De este modo les lectores cuentan con la ventaja de poder cuestionar los presupuestos normativos de fondo, la propia teoría republicana y la centralidad del valor de la libertad como no-dominación, o el modo en que son empleados para defender una propuesta de democratización. The Consistent Histories (CH) formalism aims at a quantum mechanical framework which could be applied even to the universe as a whole. CH stresses the importance of histories for quantum mechanics, as opposed to measurements, and maintains that a satisfactory formulation of quantum mechanics allows one to assign probabilities to alternative histories of a quantum system. It further proposes that each realm, that is, each set of histories to which probabilities can be assigned, provides a valid quantum-mechanical account, but that (...) different realms can be mutually incompatible. Finally, some of its proponents offer an “evolutionary” explanation of our existence in the universe and of our preference for quasiclassical descriptions of nature. The present work questions the validity of claims offered by CH proponents asserting that it solves many interpretational problems in quantum mechanics. In particular, we point out that the interpretation of the framework leaves vague two crucial points, namely, whether realms are fixed or chosen and the link between measurements and histories. Our claim is that by doing so, CH overlooks the main interpretational problems of quantum mechanics. Furthermore, we challenge the evolutionary explanation offered and we critically examine the proposed notion of a realm-dependent reality. (shrink)

El artículo analiza las ideas filosóficas de Lisandro de la Torre, dirigente político y destacado legislador argentino de vasta trayectoria pública entre 1890 y 1937, a partir de algunas conferencias y escritos de sus últimos años. En el enfoque de su cosmovisión se toman en cuenta, por un lado, la relación entre filosofía, ciencia y religión, y, por otro, la concepción antropológica, mostrando la influencia de perspectivas filosóficas como el panteísmo y el positivismo. El estudio somete a crítica la desvinculación (...) entre política y filosofía que hacía el propio de la Torre. Antes bien, concluye en que ambas esferas se encuentran conectadas y constituyen una raíz fundante del pensamiento latorrista.The article analyses Lisandro de la Torre's philosophical ideas. He was an important Argentinian politician, who had an active public life, mainly, as a legislator, between 1890 and 1937. The study is based upon some lectures and writings from his last years. His cosmological view is examined through the relation among philosophy, science and religion, on one hand, and through his anthropological account, on the other hand. The influence of pantheism and positivism is pointed out in both perspectives. It is criticised de la Torre's claim about politics as an anti-philosophical activity by arguing that philosophy and politics may be considered as foundations of his thought. (shrink)

El artículo contextualiza e investiga los detalles del «Mes de Reflexión Episcopal» organizado por el Departamento de Pastoral de Conjunto del Celam en julio de 1971, que reunió providencialmente varios obispos, algunos de los cuales no estuvieron en la II Conferencia General tres años antes, y que darían testimonio del espíritu de Medellín hasta el martirio o hasta una muerte trágica en cumplimiento de su misión: Oscar Arnulfo Romero, Juan Gerardi Conedera, Gerardo Valencia Cano y Raúl Zambrano Camader. El (...) encuentro se describe a partir de la revisión documental de las actas y de los pocos informes impresos. La tesis central del artículo es que el diálogo informal entre obispos, teólogos y otros expertos en el «Mes de Reflexión Episcopal» es fuente de propuestas novedosas para una Pastoral de Conjunto, contra la clericalización y el autoritarismo en la Iglesia latinoamericana. Desafortunadamente, no hay una reunión posterior similar debido a una controversia con la Congregación romana para los obispos. (shrink)

We critically evaluate the treatment of the notion of measurement in the Consistent Histories approach to quantum mechanics. We find such a treatment unsatisfactory because it relies, often implicitly, on elements external to those provided by the formalism. In particular, we note that, in order for the formalism to be informative when dealing with measurement scenarios, one needs to assume that the appropriate choice of framework is such that apparatuses are always in states of well defined pointer positions after measurements. (...) The problem is that there is nothing in the formalism to justify this assumption. We conclude that the Consistent Histories approach, contrary to what is claimed by its proponents, fails to provide a truly satisfactory resolution for the measurement problem in quantum theory. Alfred I. Tauber (ed.), Organism and the Origins of Self. Dordrecht, Netherlands: Kluwer Academic Publishers, 1991. xix + 384 pp., US$ 110.00 (US$ 25.00 paperback). This is a fascinating book based on a 1990 symposium at Boston University. It promises to change the way one conceives of the organism. The authors start from different specializations but provide a most tantalizing feast of ideas. Richard Lewontin commences the book with a strange foreword. Lewontin submits that the concern with the "self and (...) private identity in modern biology is ... only one manifestation of the ideology of individualism that is a shibboleth of our particular [bourgeois] form of social organization" (p. xix). If this is the case, the reader should stop reading the book and ask for her money back. But I advise patience. Tauber's introduction is a mixture of the history of the medical notion of disease and the advocacy of a dialectical concept of the self as the interpenetration of part and whole. Tauber highlights Elie Metchnikoff's appealing idea of phagocytosis as just one form of the active organism striving to attain harmony among competing cells. (shrink)

Using a purposive sample with an even distribution of 299 non-Hispanic Whites, 294 African Americans, 292 Asian Americans and 295 Hispanics, we test a moderated mediation model that examines the relationship between self-reported news media consumption (e.g., non-conservative and conservative) and environmental behavioural intentions. Our study found evidence supporting the mainstreaming hypothesis (converging attitudes) across key variables within the theory of planned behaviour (TPB). Our results also reveal non-conservative outlets to be associated with more favourable environmental attitudes, subjective norms and (...) perceived behavioural control, while conservative outlets are associated with less favourable levels for two of these three variables. Results also indicate conditional indirect relationships between non-conservative news use on behavioural intentions through our TPB variables, which vary by race/ethnicity. (shrink)

From 1989 through September 2017, Chile’s highly restrictive abortion laws exposed women to victimisation and needlessly threatened their health, freedom and even lives. However, after decades of unsuccessful attempts to decriminalise abortion, legislation regulating pregnancy termination on three grounds was recently enacted. In the aftermath, an aggressive conservative drive designed to turn conscientious objection into a pivotal new obstacle, mounted during the congressional debate, has led to extensive, complex arguments about the validity and legitimacy of conscientious objection. This article offers (...) a critical review of the emergence of conscientious objection and its likely policy and ethical implications. It posits the need to regulate conscientious objection through checks and balances designed to keep it from being turned into an ideological barrier meant to hinder women’s access to critical healthcare. Synaesthesia is a heterogeneous phenomenon, even when considering one particular sub-type. The purpose of this study was to design a reliable and valid questionnaire for grapheme-colour synaesthesia that captures this heterogeneity. By the means of a large sample of 628 synaesthetes and a factor analysis, we created the Coloured Letters and Numbers questionnaire with 16 items loading on 4 different factors . These factors were externally validated with tests which are widely used in the field of synaesthesia research. The questionnaire (...) showed good test–retest reliability and construct validity . Our findings are discussed in the light of current theories and new ideas in synaesthesia research. More generally, the questionnaire is a useful tool which can be widely used in synaesthesia research to reveal the influence of individual differences on various performance measures and will be useful in generating new hypotheses. It is necessary to reconsider P. M. S. Hacker’s assessment of Kant and Wittgenstein’s philosophical affinities and the question concerning Wittgenstein’s alleged use of “transcendental arguments”. First, Alfred Norman’s reading of the Tractatus Logico-Philosophicus as a thought experiment receives revision to develop a view of the Critique of Pure Reason as a large-scale thought experiment that shares important logical features with the Tractatus. Then the question is addressed whether the middle Wittgenstein and the pre-critical Kant employed any thought experiments that (...) could be equally characterised as “transcendental arguments”. A rational reconstruction of both thinkers’ arguments is carried out in the light of the contemporary literature on thought experimenting. The novelty and relevance of this approach is the emphasis laid upon a largely neglected affinity between Kant and Wittgenstein, namely the systematic use of thought experiments in their epistemological pursuits. The conclusions are: i) Wittgenstein’s and Kant’s magna opera can be seen as philosophical thought experiments that attempt to try out the limits of language and the limits of possible experience respectively; ii) Both philosophers developed arguments that can be designated as transcendental if only from a methodological standpoint; and iii) some key arguments put forward by the middle Wittgenstein in the determination of the structure of visual space could be characterised better as thought experiments than transcendental arguments. Consciente del significado de las interrelaciones, se considera relevante la competencia de una lengua originaria en los médicos de atención primaria y hospitalaria en sociedades y comunidades donde confluye el pluralismo cultural asistencial, en congruencia, para aproximar el contexto sociomédico y los actores específicos institucionales y comunitarios, en aras de resignificar la relación médico-paciente desde la autenticidad dialéctica de los grupos autóctonos que posibiliten atenuar los desencuentros lingüísticos dentro de los contextos plurales, otorgando el manejo integral del paciente y responder (...) a las necesidades sanitarias, una práctica compleja y retadora para reconocer la heterogeneidad étnica y cultural. Das Problem der Sterblichkeit und Unsterblichkeit gehört untrennbar zum Nachdenken des Menschen über sich und seine Stellung in der Welt. Auch für das antike Denken stellt diese Thematik ein anthropologisches Prisma dar. Es verbindet Fragen der praktischen und theoretischen Philosophie in existentiell relevanter Weise. Disziplinübergreifend beleuchtet der vorliegende Band wirkmächtige Positionen des frühgriechischen Denkens und erkundet dabei die Dimensionen menschlicher Begrenztheit.

A pesquisa vem demonstrar como é possível, a partir do pensamento de Jaques Derrida, estabelecer uma filosofia da Religião. Embora a investigação seja feita de maneira análoga e indireta, justamente porque o fenômeno da religiosidade não foi o principal objeto de sua observação, é plausível, mesmo assim, que suas teorias tais como: desconstrução, differense e o logocentrismo sirvam, e muito, como instrumento filosófico para pensar a complexidade que compõe as fronteiras da religião. Heritability is not a measure of the relative contribution of nature vis-à-vis nurture, nor is it the phenotypic variance explained by or because of genetic variance. Heritability is a correlative value. The evolutionary and developmental processes associated with human culture challenge the use of “heritability” for understanding human behavior.

En el presente trabajo tratamos de subrayar la relación entre Maimónides y Avempace. Ambos ponen el fin del hombre en la vida teorética, en la adquisición de las virtudes intelectuales y en la unión con el Intelecto Agente, que consideran un don de Dios. Igualmente, ambos insisten en la necesidad de adquirir las virtudes morales, que son un medio para lograr las intelectuales y para la formación de la vida social.
